THE CONSTITUTION OF THE UKRAINIAN ASSOCIATION
OF ANALYTICAL PSYCHOLOGY
Chapter 1. The status, name, and domicile
1.1. The Ukrainian Association of Analytical Psychology (hereinafter – UAAP or the Association) is an association of people who share views and ideas by C.G. Jung and his followers; who are interested in, study, and develop analytical psychology. It acts in accordance with the Constitution of the International Association of Analytical Psychology (IAAP) and the applicable legislation of Ukraine that regulates activities of civil society organizations. UAAP is a non-profit organization, i.e. it does not set as a goal of its activities obtaining profit for its further distribution among members of the Association (decide whether the explanation is necessary).
1.2. The name of the organization in Ukrainian and English:
1.2.1. The full name in Ukrainian: Українська Асоціація Аналітичної Психології.
1.2.2. The abbreviated name in Ukrainian: УААП.
1.2.3. The full name in English: Ukrainian Association for Analytical Psychology.
1.2.4. The abbreviated name in English: UAAP.
1.3. The official languages of UAAP are Ukrainian and English. The UAAP Constitution only has the legal effect in Ukrainian.
Chapter 2. Goals and types of UAAP activities
2.1. Goals of UAAP:
2.1.1. Setting criteria for the training and practice of Jungian analysts, determining the minimum requirements for training candidates.
2.1.2. Organization and implementation of professional training in the field of analytical psychology for qualified candidates.
2.1.3. Provision of advanced training opportunities for professionals in the field of analytical psychology.
2.1.4. Promoting dissemination (promotion) and wider perception of ideas of C.G. Jung and post-Jungians.
2.1.5. Promotion of scientific research in the field of analytical psychology.
2.1.6. Organization of cooperation with international and national organizations, individual professionals in the field of analytical psychology, psychoanalysis, and psychotherapy.
2.1.7. Adherence to high standards of training, practice, and professional ethics of Jungian analysts.
2.1.8. Establishment of the Institute of C.G. Jung ‘s Analytical Psychology.
2.2. Types of UAAP activities:
2.1.2. Organization and implementation of a training program to train professionals in the field of analytical psychology with the possibility of further IAAP certification.
2.2.2. Establishment of the Committees and Commissions required to implement UAAP’s goals.
2.2.3. Inviting for cooperation international organizations and individual professionals in the field of analytical psychology, psychoanalysis, and psychotherapy.
2.2.4. Establishing relations with other countries’ national organizations of analytical psychologists.
2.2.5. Organization and holding of professional events (lectures, seminars, conferences, round tables, discussions, other projects) on analytical psychology and psychotherapy.
2.2.6. Participation in IAAP events (congresses, conferences, etc.).
2.2.7. Organization of translation into Ukrainian and further publication of works by C.G. Jung, post-Jungians, other well-known professionals in the field of analytical psychology, psychoanalysis, and psychotherapy.
2.2.8. Publication of a regular professional printed edition (journal) containing materials in the field of analytical psychology, psychoanalysis, and psychotherapy.
Chapter 3. UAAP membership, rights and obligations of members
3.1. Membership in the Ukrainian Association of Analytical Psychology can only be individual. UAAP membership may comprise citizens of Ukraine, foreign citizens, and stateless persons.
3.2. There are four categories of UAAP membership:
3.2.1. Full member.
3.2.2. Affiliate member.
3.2.3. Associate member.
3.2.4. Honorary member.
3.3. Full UAAP members.
3.3.1. Full membership is accessible to Jungian analysts who graduated from the UAAP training. In addition, full membership is accessible to individual IAAP members who have received confirmation of their Jungian analyst status at an IAAP Congress, or individuals who are members of organizations that are IAAP Group Members.
3.3.2. To obtain the status of a full member, a person who meets the criteria specified in p. 3.3.1 must submit an application for admission addressed to the name of the UAAP President. The decision regarding granting the full member status to such a person is decided at the UAAP General Assembly by secret ballot. A person who has undergone UAAP training, passed the final exam, and received confirmation of his/her status as a Jungian analyst within the UAAP automatically becomes a full UAAP member starting from the moment of announcement of his/her Jungian analyst status at a UAAP General Assembly. (As acceptance of UAAP graduates as full members is automatic it is not dependent of the General Assembly and can in principle happen when the Jungian analyst status is confirmed by the Training Committee)
3.3.3. A full UAAP member has the right to:
3.3.3.1. Participate in the General Assembly and vote.
3.3.3.2. Delegate his/her vote to another full member by submitting the respective application in writing addressed to the name of the UAAP President. Each full member can obtain by delegation no more than one vote of another full member.
3.3.3.3. Elect and be elected the UAAP President, Vice-President, Secretary, Treasurer, or a member of UAAP collective bodies (Board, Ethics Committee, or Training Committee).
3.3.4. A full UAAP member is obliged to:
3.3.4.1. Pay the accession and annual membership fees in a timely manner in the amount and according to the procedures established by the decision of the General Assembly.
3.3.4.2. Strictly adhere to provisions of the UAAP Code of Ethics.
3.3.4.3. On a regular basis, improve his/her professional qualifications by actively participating in UAAP and IAAP programs and events.
3.4. Affiliate UAAP members.
3.4.1. An affiliate UAAP member can be a Jungian analyst who is part of an IAAP group member in another country.
3.4.2. To obtain the status of an affiliate member, a person must submit an admission application to the name of the UAAP President. The decision regarding granting the affiliate member status to such a person is decided at the UAAP General Assembly by secret ballot.
3.4.3. Affiliate members do pay annual membership fees and they pay admission membership fees.
3.4.4. An affiliate member may participate in the General Assembly without the right to elect and be elected the President, Vice-President, Secretary, Treasurer, or to the UAAP collective bodies (Board, Ethics Committee, Training Committee) and speak on issues under consideration but he/she does not have the right to vote.
3.5. Associate UAAP members.
3.5.1. Any person who shows interest in the analytical psychology of C.G. Jung can become an associate UAAP member. Associate Members are not Jungian analysts and do not have the right to refer to themselves as Jungian analysts.
3.5.2. To become an associate UAAP member, a person must submit an application to the name of the UAAP President, receive recommendations from two UAAP full members, and pass an accession interview with two members of the UAAP Board. The decision on admission of an associate UAAP member is made at the General Assembly by secret ballot.
3.5.3. An associate member has the right to:
3.5.3.1. Participate in the UAAP General Assembly without the right to elect and be elected the President, Vice-President, Secretary, Treasurer, or to the UAAP collective bodies (Board, Ethics Committee, Training Committee), speak on issues under consideration, but he/she does not have the right to vote.
3.5.3.2. Participate in lectures, seminars, other events held by UAAP.
3.5.3.3. If the criteria are met, apply for full UAAP membership by completing the UAAP training program, passing the final exam, and having the Jungian analyst status confirmed at an IAAP Congress.
3.5.3.4. Offer his/her materials on topics of analytical psychology and psychotherapy for publication.
3.5.3.5. Receive information about all UAAP events.
3.5.4. An associate UAAP member is obliged to:
3.5.4.1. Timely pay accession and annual membership fees in the amount established with the decision of the General Assembly.
3.5.4.2. Recognize the UAAP Constitution and Code of Ethics and act in compliance with them.
3.6. Honorary UAAP members.
3.6.1. An honorary member can be a person who is not a Jungian analyst but who has made a significant contribution to promotion and dissemination of ideas of C.G. Jung and post-Jungians in Ukraine.
3.6.2. The offer to grant a person the status of an honorary UAAP member can be submitted to the UAAP President by a full member in writing with the rationale for such an offer.
3.6.3. The decision to grant a person the status of an UAAP honorary member is made at the General Assembly by secret ballot.
3.6.4. Honorary UAAP members do not pay membership fees but may make charitable contributions.
3.6.5. Honorary UAAP members can participate in UAAP General Assemblies (without the right to elect and be elected the President, Vice-President, Secretary, Treasurer, or members of UAAP collective bodies (Board, Ethics Committee, Training Committee), speak on issues under consideration, but they do not have the right to vote.
3.7. Termination (suspension) of UAAP membership.
3.7.1. UAAP membership may be terminated or suspended by a decision of the General Assembly by secret ballot under the following circumstances:
3.7.1.1. Based on the member’s written application to terminate (suspend) his/her membership submitted to the name of the UAAP President.
3.7.1.2. In case of death of the UAAP member.
3.7.1.3. In case of a significant violation of professional standards or the Code of Ethics.
3.7.1.4. In case of non-payment of membership fees for more than 12 months.
Chapter 4. The structure of UAAP governing bodies
4.1. UAAP activities are executed on democratic grounds in compliance with the UAAP Constitution and the applicable legislation of Ukraine.
4.2. The highest UAAP governing body is the General Assembly of UAAP members.
4.2.1. The date, time, and place of the General Assembly are determined by the UAAP Board.
4.2.2. Information about the date, time, and place of the General Assembly is communicated to UAAP members by the UAAP Secretary by way of sending e-mails to members’ e-mail addresses specified by them in their applications for joining the UAAP. In the event of a change of the e-mail address and failure to provide the Secretary with information about a new, up-to-date e-mail within three days after such change, the UAAP is not liable for not notifying the member of the date, time, and place of the General Assembly.
4.2.3. General Assemblies may be regular or extraordinary.
4.2.4. Regular General Assemblies are held at least once every six months at the date and time announced by the means specified in Art. 4.4, no later than two weeks before the General Assembly.
4.2.5. Extraordinary General Assemblies can be convened at the initiative of the UAAP President, the UAAP Board, or at a written request of at least 1/3 of the total number of UAAP full members. The written request indicating the issues that, according to the initiators, need to be resolved during the extraordinary General Assembly (Agenda) is submitted to the UAAP Board, which determines the date and time of the Assembly. According to the same procedures, the right to initiate extraordinary General Assemblies is granted to the Audit Commission in case they detect violations committed in accounting of UAAP funds or property. Information about the date and time of an extraordinary General Assembly must be notified to members by the means specified in Art. 4.4, no later than three days before the General Assembly.
4.2.6. The quorum (the smallest number of participants required for the assembly to be deemed as having the authority to make decisions on items in the agenda) of the General Assembly is more than 50% of the total number of UAAP full members (50% + 1 person). To determine presence or absence of a quorum, votes of both UAAP full members personally present at the meeting, as well as votes delegated by absent full members according to the rules set in p. 3.3.3.2 of this Constitution must be accounted for.
4.2.7. At the General Assembly, the following mandatory issues are considered and decided:
4.2.7.1. Amendments to the UAAP Constitution.
4.2.7.2. Exclusion from UAAP membership.
4.2.7.3. Dissolution of the UAAP.
4.2.7.4. Elections of the UAAP President.
4.2.7.5. Elections of the Vice President – Chair of the Ethics Committee.
4.2.7.6. Elections of the Vice President – Chair of the Training Committee.
4.2.7.7. Elections of Ethics Committee members.
4.2.7.8. Elections of the Training Committee members.
4.2.7.9. Elections of the UAAP Secretary.
4.2.7.10. Elections of the UAAP Treasurer.
4.2.7.11. Admission to UAAP membership.
4.2.7.12. Adoption of the annual report of the UAAP President.
4.2.7.13. Adoption of the annual report of the UAAP Board.
4.2.7.14. Adoption of the annual financial report of the UAAP Treasurer.
4.2.7.15. Approval of the amount, terms, and procedures for payment of membership fees, liability for non-compliance with them.
4.2.7.16. Approval of the amount and procedures of payment for participation in paid training, educational, awareness-raising programs (events).
4.2.8. Decisions on the issues specified in pp. 4.2.7.1-4.2.7.3 are adopted by a qualified majority of 2/3 of votes of those present at the meeting (taking into account votes of the absent members who delegated their votes according to the rules set in p. 3.3.3.2 of this Constitution).
4.2.9. Decisions on other issues (pp. 4.2.7.4-4.2.7.16) are adopted by a simple majority of votes (1/2 of the number of those present at the meeting (taking into account votes of absent full members who delegated their votes according to the rules set in p. 3.3.3.2 of this Constitution) plus one vote).
4.3. The body that guides current activities of the UAAP and implements decisions made at the General Assembly is the UAAP Board.
4.3.1. The Board comprises 5 people: the President, two Vice-Presidents (Chairs of the Ethics Committee and the Training Committee), the Secretary, and the Treasurer.
4.3.2. Each Board member is elected for the term of three years with the possibility of re-election for a second term. Election for a third term is possible only after a three-year break in the relevant position.
4.3.3. To implement decisions made at the General Meeting, the Board involves UAAP members.
4.3.4. The Board holds its meetings at least once every three months.
4.4. The UAAP President (elected from among UAAP full members) has the following powers:
4.4.1. Organization and control of administrative activities of the UAAP Board.
4.4.2. Presiding over the General Assembly.
4.4.3. Official representation and acting in interests of the UAAP in contacts (interaction) with other professional organizations and associations, authorities, the press, and the public.
4.4.4. Making day-to-day current decisions in the interests of the UAAP.
4.4.5. Initiation and implementation of new UAAP projects.
4.4.6. Informing UAAP members personally or via the UAAP Secretary about IAAP decisions that are relevant for the UAAP status and activities.
4.5. The UAAP Vice-President (elected from among UAAP full members) has the following powers:
4.5.1. Organization of current activities of the UAAP.
4.5.2. Management (guidance) of UAAP ongoing projects.
4.5.3. Performing duties of the UAAP President on his/her behalf in the absence of the President or in the event that it becomes necessary for other reasons.
4.6. The UAAP Secretary (elected from among UAAP full members) has the following duties.
4.6.1. Informing UAAP members about ongoing activities, educational and training projects, professional events (lectures, seminars, conferences, discussions, round tables, etc.) by dissemination of the relevant information by way of sending messages to email addresses of UAAP members.
4.6.2. Maintaining contacts (via regular or e-mail correspondence, exchange of messages in messengers, of phone calls) with IAAP, other professional organizations, and UAAP members.
4.6.3. Keeping minutes of the UAAP General Assembly.
4.7. The UAAP Treasurer (elected from among UAAP full members) has the following duties:
4.7.1. Accounting of financial revenues (membership fees, fees for participation in training or educational programs (events), charitable contributions, etc.) and expenses.
4.7.2. Accounting of property owned by the UAAP.
4.7.3. Reporting on results of financial activities and the status of UAAP property at the annual UAAP General Assembly.
4.7.4. Redistribution of funds within the approved budget, if necessary.
4.8. The UAAP Audit Commission (elected from among UAAP full members) consists of three people (the Chair and two members) elected for the term of three years with the possibility of their re-election for a second term. Election for a third term is only possible after a three-year break in the UAAP Audit Commission.
4.8.1. Members of the Audit Commission cannot be members of the UAAP Board.
4.8.2. The Audit Commission controls spending of UAAP funds.
4.8.3. The Audit Commission may submit any issues for consideration of the General Assembly based on results of the audits it held, including initiating convening of an extraordinary General Assembly according to the procedures specified in p. 4.2.5 of this Constitution.
4.9. The UAAP Ethics Committee is a standing group body of the UAAP.
4.9.1. The Ethics Committee consists of four people (the Chair and three members).
4.9.2. The person elected as the Chair of the Ethics Committee is a UAAP Vice-President and a member of the UAAP Board.
4.9.3. The goal of the Ethics Committee’s activities is to monitor compliance by UAAP members with the Code of Ethics, consider complains (study the information) regarding violations of the Code of Ethics by UAAP members, and to decide on response measures (including the possibility of bringing the issue of expulsion from UAAP members for consideration of the General Assembly) regarding confirmed violations.
4.9.4. The detailed procedures for establishment and activities of the Ethics Committee are regulated by the Ethics Committee Regulations to be approved by the UAAP General Assembly.
4.9.5. The Code of Ethics, provisions of which must be followed by all valid, affiliate and associate UAAP members, is approved by the UAAP General Assembly.
4.10. The UAAP Training Committee is a standing UAAP group body.
4.10.1. The training committee consists of three people (the Chair and two members).
4.10.2. The person elected as the Chair of the Training Committee is a UAAP Vice-President and a member of the UAAP Board.
4.10.3. The goal of the Training Committee is to develop, organize, and conduct professional training programs, including supervision ones, upon successful completion of which one can possibly obtain the status of a UAAP full member. The Training Committee also organizes and conducts events (lectures, seminars, conferences, supervisions, discussions, round tables, etc.) that will offer an opportunity to improve professional qualifications of UAAP members.
4.10.4. To implement a specific project, the Training Committee appoints a Coordinator from among Training Committee members. If necessary, the Training Committee can involve as Coordinators UAAP full members who are not Training Committee members.
4.10.5. Duties of the Training Committee include development of proposals for the cost of paid training, education, and awareness raising programs (events). The specified proposals are subject to further approval by the UAAP General Assembly.
4.10.6. The detailed procedures for establishment and activities of the Training Committee are regulated by the Training Committee Regulations to be approved by the UAAP General Assembly.
Chapter 5. Property and finances
5.1. The Ukrainian Association of Analytical Psychology is the owner of all property acquired by it on the grounds determined by law, i.e. it freely owns, uses, and disposes of all property belonging to the UAAP.
5.2. The UAAP property consists of any real estate, movable property, money, equipment, belongings, intellectual property rights objects (information, publications, books, journals, websites, etc.) and any other property.
5.3. UAAP members cannot be owners of a share of property belonging to the Association.
5.4. UAAP members lose their rights to property transferred by them to the Association, including membership fees.
5.5. No UAAP property item may be used in personal interests of members of the Association, their relatives, or close people.
5.6. Sources of UAAP funds and property are:
5.6.1. Admission and annual membership fees.
5.6.2. Voluntary charitable monetary contributions or property transferred by legal entities and individuals, including UAAP members, to UAAP ownership.
5.6.3. Cash received as payment for training, educational, awareness-raising programs (events).
5.6.4. Other sources not prohibited by the current legislation of Ukraine.
5.7. Cash and other property belonging to the UAAP can be used to finance the goals and types of activities specified in p. 2.1, 2.2, in particular to cover current costs of the Association, organization of paid or free training, educational, awareness-raising programs (events) – lectures, seminars, conferences, supervisions, etc.
5.8. The UAAP Treasurer is responsible for financial accounting of revenues and expenditures of funds.
Chapter 6. Termination of UAAP activities
6.1. Termination of UAAP activities is performed by means of its reorganization or liquidation.
6.2. Reorganization of the UAAP is performed in compliance with the applicable legislation of Ukraine that regulates this issue, and on the grounds of this Constitution. After reorganization of the UAAP, all of its rights and obligations pass to its legal successor.
6.3. Liquidation of the UAAP is performed on the grounds of this Constitution in compliance with the applicable legislation of Ukraine that regulates this issue, or with a court decision. In case of liquidation of the UAAP, the General Assembly that approves liquidation of the UAAP determines the procedures and terms of the liquidation.
6.4. Upon UAAP liquidation, all of its property, after settlement of liabilities, is used with the decision of the General Assembly for fulfillment of statutory objectives or for charitable purposes related to goals of the UAAP.
6.5. Rights to any UAAP property cannot be transferred to UAAP members in the course of liquidation.
